Introductory Provision\u003Cbr \/\u003E\u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cul\u003E\r\n\u003Cli\u003EThese GTC govern the purchase of a time-limited user license for the use of the MyWay analytix web application, which is available through the website https:\/\/mywayanalytix.com\/ (hereinafter referred to as \u0022the website\u0022) and is designed for a comprehensive evaluation of the current state of an individual\u0027s mental health (hereinafter referred to as \u0022MyWay\u0022).\u003C\/li\u003E\r\n\u003C\/ul\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E2. Seller and Contacts \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E2.1. The seller, or service provider through the website, is the company MilkyWay be well s.r.o., identification number: 109 91 859, with its registered office at Slune\u010dn\u00ed 1120, 252 10, Mn\u00ed\u0161ek pod Brdy, registered in the Commercial Register maintained by the Municipal Court in Prague, file no. C 351921 (also referred to as \u0022MyWay\u0022). 2.2. Order and Conclusion of Contract \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E3.1. MyWay allows the customer (hereinafter referred to as \u0022user\u0022) to enter into a contract based on which the user gains access to MyWay analytix after payment of the license fee.\u003C\/p\u003E\r\n\u003Cp\u003E3.2. Only a natural person as a consumer over the age of 18 can be a user. 3.3. Detailed information about MyWay analytix is available on the website. 3.4. The registration form must be filled out correctly (all mandatory fields), accurately and truthfully by the user.\u003C\/p\u003E\r\n\u003Cp\u003E3.5. The user has the option to choose in the registration form whether to order paid access to MyWay analytix without the possibility to obtain a contribution towards the price from their health insurance company (hereinafter referred to as \u0022self-payer\u0022) or with the possibility to obtain a contribution towards the price from their health insurance company (hereinafter referred to as \u0022insured\u0022).\u003C\/p\u003E\r\n\u003Cp\u003E3.6. The user is responsible for the accuracy of the provided information.\u003C\/p\u003E\r\n\u003Cp\u003E3.7. The user places an order for access by filling out the registration form directly on the website within the order form.\u003C\/p\u003E\r\n\u003Cp\u003E3.8. Access to MyWay analytix can only be ordered for a fixed period with validity for 12 months from the date of purchase.\u003C\/p\u003E\r\n\u003Cp\u003E3.9. The contract for access to MyWay analytix is concluded at the moment of payment of the license fee.\u003C\/p\u003E\r\n\u003Cp\u003E3.10. An already paid access to MyWay analytix cannot be cancelled or refunded, even on the grounds that the user did not utilize it.\u003C\/p\u003E\r\n\u003Cp\u003E3.11. MyWay will confirm the user\u0027s order electronically to the contacts provided by the user in the registration form.\u003C\/p\u003E\r\n\u003Cp\u003E3.12. The subscriber is obligated to notify MyWay immediately of any change in the details they provided for access to MyWay analytix, by updating this information in their profile within MyWay analytix.\u003C\/p\u003E\r\n\u003Cp\u003E3.13. The contract is concluded for a fixed period corresponding to the length of the ordered license for access.\u003C\/p\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E4. Availability and Use of MyWay analytix \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E4.1. The MyWay analytix application is available electronically only through the website by entering access details.\u003C\/p\u003E\r\n\u003Cp\u003E4.2. The user undertakes to protect their access data to MyWay analytix and not to disclose it to any third parties.\u003C\/p\u003E\r\n\u003Cp\u003E4.3. The user undertakes to protect access to their device through the appropriate protective elements (e.g., passwords, etc.) and protect these protective elements to prevent access to MyWay analytix by unauthorized persons.\u003C\/p\u003E\r\n\u003Cp\u003E4.4. The MyWay analytix user account is non-transferable and is tied to the single person of the user.\u003C\/p\u003E\r\n\u003Cp\u003E4.5. MyWay analytix can only be used through appropriate hardware and software equipment with internet access of sufficient connection capacity. The user is not entitled to apply defects of MyWay analytix in case they do not have appropriate hardware or software equipment or sufficient internet connection. The subscriber acknowledges that MyWay analytix may not be available for all types of hardware and software equipment.\u003C\/p\u003E\r\n\u003Cp\u003E4.6. In the event that the user finds that there has been a loss or theft of access to the user account, they are obliged to change the access permissions or contact MyWay.\u003C\/p\u003E\r\n\u003Cp\u003E4.7. MyWay analytix is available continuously for the entire duration of the license. This does not affect the right of MyWay to carry out necessary maintenance of MyWay analytix as appropriate.\u003C\/p\u003E\r\n\u003Cp\u003E4.8. MyWay is not responsible for the availability of MyWay analytix in cases beyond its control, such as system failure, system attacks.\u003C\/p\u003E\r\n\u003Cp\u003E4.9. The user is not entitled to compensation for any damage incurred while using MyWay analytix due to unavailability or malfunction of MyWay analytix. 4.10. If MyWay analytix contains links to third party websites, MyWay is not responsible for their content or for these links.\u003C\/p\u003E\r\n\u003Cp\u003E4.11. MyWay is entitled to block the user account or access to MyWay analytix of a user who violates these GTC, acts contrary to legal regulations or infringes on the rights of MyWay or third parties, or if they would damage the good name of MyWay.\u003C\/p\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E5. Price of MyWay analytix and Payment Terms \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E5.1. The price of the annual license is 1099 CZK including VAT. Details on pricing can be found at www.milkywaybewell.com\u003C\/p\u003E\r\n\u003Cp\u003E5.2. The price indicated in the order form is final and includes all taxes and fees.\u003C\/p\u003E\r\n\u003Cp\u003E5.3. The method of payment is only in advance, via a payment gateway after placing an order.\u003C\/p\u003E\r\n\u003Cp\u003E5.4. MyWay uses the GoPay payment gateway for credit card payments. More information about the payment gateway is available at \u003Ca href=\u0022https:\/\/www.gopay.com\/\u0022\u003Ehttps:\/\/www.gopay.com\/\u003C\/a\u003E\u003C\/p\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E6. Termination of the Contract \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E6.1. MyWay is entitled to terminate the contract for access to MyWay analytix if it is found that the user violates the contract including these GTC, acts contrary to legal regulations, or interferes with the rights of MyWay or third parties, or if they would tarnish the good name of MyWay.\u003C\/p\u003E\r\n\u003Cp\u003E6.2. MyWay is not responsible for any damages caused to the user by not concluding the contract or by withdrawing from the contract or by its termination.\u003C\/p\u003E\r\n\u003Cp\u003E6.3. The user is entitled to terminate the contract by email sent to \u003Ca href=\u0022mailto:info@mywayanalytix.com\u0022\u003Einfo@mywayanalytix.com\u003C\/a\u003E\u003C\/p\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E7. Complaint Procedure \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E7.1. MyWay is responsible for fulfilling its obligations under the contract including these GTC.\u003C\/p\u003E\r\n\u003Cp\u003E7.2. If MyWay does not properly and timely provide the user access to MyWay analytix or does not ensure the proper functioning of MyWay analytix, the user has the right to make a claim with MyWay.\u003C\/p\u003E\r\n\u003Cp\u003E7.3. The user is obliged to submit a claim without delay, no later than within 7 days.\u003C\/p\u003E\r\n\u003Cp\u003E7.4. In the case of a justified claim, which will be duly and timely filed with MyWay and recognized by MyWay, MyWay will ensure proper and timely access to MyWay analytix for the user or ensure the proper functioning of MyWay analytix and if this is not possible, MyWay will refund the user a pro-rata part of the price.\u003C\/p\u003E\r\n\u003Cp\u003E7.5. The user submits the claim through MyWay contacts.\u003C\/p\u003E\r\n\u003Cp\u003E7.6. The complaint procedure is an integral part of the GTC.\u003C\/p\u003E\r\n\u003Cp\u003E7.7. Documentation for the concluded contract is an invoice delivered electronically to the user after the payment is made.\u003C\/p\u003E\r\n\u003Cp\u003E7.8. The user may object to a defect that occurs or manifests itself on MyWay analytix within two years from the date of acceptance.\u003C\/p\u003E\r\n\u003Cp\u003E7.9. MyWay will decide on the claim immediately, in complex cases within three working days. This time limit does not include the time appropriate for a professional assessment of the defect. MyWay will resolve the claim including the defect removal without undue delay, no later than within 30 days from the next day after the claim is filed. The period of 30 days can be extended after the claim has been made upon agreement with the user \u2013 such an extension cannot be for an indefinite period or unreasonably long. After the expiration of the period, or the extended period, it is assumed that the defect actually existed and the user has the same rights as if it was a defect that could not be removed.\u003C\/p\u003E\r\n\u003Cp\u003E7.10. MyWay always issues confirmation of receiving the claim including its processing for the user.\u003C\/p\u003E\r\n\u003Cp\u003E7.11. The user has the right to reimbursement of reasonably incurred costs associated with filing a justified claim. These costs are understood as the least necessary.\u003C\/p\u003E\r\n\u003Cp\u003E7.12. The user may request an appropriate discount or withdraw from the contract if MyWay refuses to remove the defect or does not remove it in accordance with the requirements of the complaint procedure and the Civil Code; the defect occurred repeatedly; the defect represents a substantial breach of the contract; or it is clear that MyWay will not remove the defect within a reasonable time or without significant difficulties for the user. For an unreasonable time or significant difficulties for the user, the claim period or the need for the user\u0027s cooperation are not considered.\u003C\/p\u003E\r\n\u003Cp\u003E7.13. The user is not entitled to withdraw from the contract if the defect is insignificant.\u003C\/p\u003E\r\n\u003Cp\u003E7.14. MyWay is not obliged to meet the user\u0027s claim if the user knew or must have known about the defect before concluding the contract with the exercise of usual attention, or if the user himself caused the defect.\u003C\/p\u003E\r\n\u003Cp\u003E7.15. The rights and obligations of the contracting parties regarding the rights from defective performance not regulated by these GTC are governed by the relevant legal regulations, in particular by the provisions of \u00a7 2615 and \u00a7 2099 et seq. of Act No. 89\/2012 Coll., as amended (the \u0022Civil Code\u0022).\u003C\/p\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E8. Consumer Rights \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E8.1. A consumer is every person who, outside the scope of their business activities, outside the activities of their employer, or outside the independent exercise of their profession, concludes a contract with an entrepreneur or otherwise deals with them (also referred to as \u0022the consumer\u0022).\u003C\/p\u003E\r\n\u003Cp\u003E8.2. Contact details to which the consumer can turn are given in Article 2 of these GTC.\u003C\/p\u003E\r\n\u003Cp\u003E8.3. The contract for access to MyWay analytix is concluded in the Czech language, is stored in an electronic form by MyWay and is not publicly accessible. The consumer always receives these GTC together with the order confirmation.\u003C\/p\u003E\r\n\u003Cp\u003E8.4. The seller is not bound by any code of conduct in relation to the consumer.\u003C\/p\u003E\r\n\u003Cp\u003E8.5. The seller issues a complaint procedure and application of defects defined in these GTC. The complaint procedure includes the scope, conditions, and manner of exercising rights from defective performance and places where a complaint can be filed.\u003C\/p\u003E\r\n\u003Cp\u003E8.6. The consumer\u0027s right to withdraw without reason within 14 days from the date of conclusion of the contract does not arise for the consumer, as access to MyWay analytix is provided as digital content without tangible media, which was made available to the user with their prior explicit consent before the expiration of the mentioned withdrawal period.\u003C\/p\u003E\r\n\u003Cp\u003E8.7. Procedure for handling complaints: \u2022 The consumer is entitled to file a complaint with MyWay. \u2022 MyWay has designated a responsible person for receiving complaints and this person accepts complaints. \u2022 MyWay always electronically confirms the recording of the complaint. \u2022 In the case of a repeated complaint, the responsible person is in charge of discussing the complaint with a superior. \u2022 The seller handles complaints without unnecessary delay, no later than within 30 calendar days. \u2022 The user is informed about the handling of the complaint electronically, and no later than the period mentioned in the previous paragraph.\u003C\/p\u003E\r\n\u003Cp\u003E8.8. Entity for out-of-court consumer dispute resolution: \u2022 MyWay hereby informs the consumer of the existence of the entity for out-of-court consumer dispute resolution, which is the Czech Trade Inspection Authority, with headquarters at \u0160t\u011bp\u00e1nsk\u00e1 567\/15, 120 00 Prague 2, tel.: 296 366 360, website \u003Ca href=\u0022http:\/\/www.coi.cz\u0022\u003Ehttp:\/\/www.coi.cz\u003C\/a\u003E.\u003C\/p\u003E\r\n\u003Cp\u003E8.9. Supervisory authorities: \u2022 If a consumer believes that their statutory consumer rights have been violated by MyWay, they have the right to submit their complaint to the Czech Trade Inspection Authority.\u003C\/p\u003E\r\n\u003Cp\u003E\u00a0\u003C\/p\u003E\r\n\u003Cp\u003E\u003Cstrong\u003E9. FINAL PROVISIONS \u003C\/strong\u003E\u003C\/p\u003E\r\n\u003Cp\u003E9.1. These GTC and the contract concluded according to them are governed by Czech law.\u003C\/p\u003E\r\n\u003Cp\u003E9.2. In the case of a dispute, the competent court will be the one with local and substantive jurisdiction determined according to the place of business of MyWay.\u003C\/p\u003E\r\n\u003Cp\u003E9.3. MyWay can change these GTC to a reasonable extent, especially in the case of: \u2022 Changes in the settings and functions of MyWay analytix, \u2022 Change or cancellation of relevant legal regulations, \u2022 Unpredictable changes in the market.\u003C\/p\u003E\r\n\u003Cp\u003E9.4. The change will be announced according to MyWay\u0027s choice typically by sending the relevant information and the wording of the change of conditions, or the full text of these conditions in a suitable format to the user\u0027s contact email address or other written notification.\u003C\/p\u003E\r\n\u003Cp\u003E9.5. In case the user does not agree with the respective change in the GTC, they are entitled to terminate the contract no later than 30 days before the effective date of the respective change. If the user does not exercise their right to terminate the contract, it implies their consent to the change.\u003C\/p\u003E\r\n\u003Cp\u003E9.6. The terms of processing personal data of users of MyWay analytix are specified in the Principles of processing personal data of users of the MyWay analytix system, which are available on the website.\u003C\/p\u003E\r\n\u003Cp\u003E9.7.
